Applying Process For US H-1B visa

• When you get selected for the H-1B visa then only your employer can initiate the process by filling out a petition on your behalf.
• To initiate your employer will need to submit a Labour Condition Application (LCA) to the Department of Labour (DOL) for certification. The reason behind LPA is to ensure that your employer will pay you the same as other employees with similar qualifications and in the same geographical area.
• When the LCA has been certified by DOL your employer will have to complete form-129 which is a petition for a Nonimmigrant worker, and file both the LCA and the 1-129 to USCIS, with any fee and additional documents. These other documents may include your education proofs like professional membership documents, any training certificates or resumes etc.
• If your form-129 is approved then you will have two options to go which depend upon whether you are in the United States or not.
• If there is a condition in which you are in the US on a different visa category then you need to wait until your H-1B visa status becomes active for you to start working.
• If you are an outsider you need to apply for consular processing. To do this, you will need to complete Form DS-160, which will take approximately 90 minutes to fill in. You will need to pay the application fee and schedule an interview at a U.S. embassy or consulate near you.
