  • Punishes people responsible for sexual assault against Dalit and Adivasi women.

Ques 3. Why did the Safai Karamchari Andolan file a PIL in 2003? What did they complain about in their petition?

Ans: The Safai Karamchari Andolan filed a PIL in 2003 as the state failed to implement the Employment of Manual Scavengers and Construction of Dry Latrines (Prohibition) Act, 1993.

They complained that manual scavenging is still prevalent, even in government sectors like railways. 

Ques 4. What did the Supreme Court do on hearing their case in 2005?

Ans: The Supreme Court of India observed the following:

  • Increase in manual scavengers despite the 1993 Act.
  • It directed the government departments to:
  1. Verify the existence of manual scavenging within 6 months.
  2. Implement time-bound programs for the liberation and rehabilitation of identified manual scavengers.

Ques 1. List two Fundamental Rights in the Constitution that Dalits can draw upon to insist that they be treated with dignity and as equals. Re-read the Fundamental Rights listed on page 14 to help you answer this question.

Ans: Here are the two fundamental rights that Dalits can draw upon to insist that they be treated with dignity and as equals:

Article 15: Prohibition of discrimination on account of religion, caste, race, sex, or place of birth.
As per Article 15 of the Indian Constitution, the state and the people of the country cannot treat anyone differently because of their race, religion, caste, gender, or birthplace. This implies that every citizen of the nation has access to public places and government facilities without discrimination based on these factors. 

Article 17: Abolition of untouchability

According to Article 17 of the Constitution of India, untouchability is a punishable offence in the country. Also, this article guarantees access to education, temples, and public facilities to Dalits. 

Ques 2. Re-read the story on Rathnam as well as the provisions of the 1989 Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act. Now list one reason why you think he used this law to file a complaint.

Ans: Rathnam filed a case under the Scheduled Castes and the Scheduled Tribes (Prevention of Atrocities) Act, 1989 because this law punishes perpetrators of crimes against tribals and prevents people from indulging in discriminatory and criminal activities against Adivasis. 

Ques 3. Why do Adivasi activists, including C.K. Janu, believe that Adivasis can also use this 1989 Act to fight against dispossession? Is there anything specific in the provisions of the Act that allows her to believe this?

Ans: Adivasis activists like C.K. Janu believe that they can use the 1989 Act against dispossession because of the following Constitutional safeguards guaranteed by this act:

  • Adivasi land cannot be sold to non-tribals.
  • Evicted Adivasis have the right to reclaim their land.

Ques 4. The poems and the song in this Unit allow you to see the range of ways in which individuals and communities express their opinions, their anger and their sorrow. In class, do the following two exercises:

(a) Bring to class a poem that discusses a social issue. Share this with your classmates. Work in small groups with two or more poems to discuss their meaning as well as what the poet is trying to communicate.

(b)Identify a marginalised community in your locality. Write a poem, or song, or draw a poster etc. to express your feelings as a member of this community.
