Short Term Stream 

It allows Indian labour to stay and work in Australia for 2 years to 4 years. The occupation must be listed on the short-term skilled occupation list and labour should have 2 years of relevant work experience. You can also travel to and from Australia within the validity of your Visa. The application cost is AUD 1290 / ₹68,453.

Medium Term Stream

It allows the Indian Labour to stay and work in Australia for 4 years. They can study alongside being employed by the Australian employer and also apply for permanent residency if eligible. The application cost is AUD 2690/₹1,42,687. The desired occupation should be listed on the medium and short-term strategic skills list or regional occupation list. 

Labour Agreement Stream

Australian employers who have a labour agreement with the Australian government can sponsor Indian labour for a temporary time period and allow them to work and live in Australia. The Visa application cost is the same as it is for medium-term streams.

Eligibility for 482 Visa

There is a set of eligibility requirements that Indian labour and Australian employers must have to qualify for the temporary skill shortage Visa.

  • Occupation should be listed on the Consolidated Occupation List
  • 2 years of work experience in the relevant field
  • Skills and educational qualifications for the job that you are employed in Australia
  • Proof of English Proficiency
  • Satisfied DHA (Department of Home Affairs in Australia) tests for good character and health 

If you are an Australian employer planning to sponsor skilled labour from India, you have to fulfil the following conditions:

  • Must have a lawfully operating business
  • No adverse information against the business
  • Employ an Indian worker for a genuine and full-time job

English Requirements for a Temporary Skill Shortage Visa

For your 482 visa, you must produce evidence that you meet the minimal English language competence standards, which vary depending on the visa stream you are applying for.

You must also show that you passed the test within one attempt and that you took it at least three years before applying for the visa.

Age Restriction for a TSS 482 Visa

A TSS visa has no age limit; however, there is one for Permanent Residency. If you are granted a visa in an MLTSSL occupation and want to apply for permanent residency after three years of working for the same sponsor, you must be under 45 at the time of application, unless you qualify for an exception.

Application Process for 482 Visa

Getting the 482 subclass Visa is a process initiated by the Australian sponsor only after you meet the eligibility requirements. Applying for a temporary skill shortage Visa can be a lengthy process.

  • Find whether you are eligible for the 482 subclass Visa or not
  • If eligible, start looking for work opportunities in Australia that are ready to employ Indian immigrants. 
  • Once you get the job, your Australian employer will nominate you for the Temporary Skill Shortage Visa.
  • After you receive the nomination, you can apply for the 482 Visas online from the DHA portal. 
  • It can take anywhere between 6-12 months for your Visa to be processed.
  • Once you receive the Visa, you can fly to Australia for your work 

Note: Australian Immigration is very rigid and thorough with its screening process to avoid any kind of unwanted immigrant entering the country. Hence, the processing time takes a few months. Applicants have to appear for the interview as well. 

Checklist of Documents for Your Sponsor

Your sponsor must also prepare the following documents before submitting their nomination:

  • Identification documents: Your sponsor must give your entire name, birthdate, and any other details relevant to the job.
  • Employment agreement: Unless they are exempt, your employer must give you a copy of your employment contract.
  • Evidence of the AMSR: The individual who put your name forward for the visa must show proof that they will match the income threshold for temporary skilled migration with the annual market salary rate.
  • Evidence of labour market testing: Your sponsor must show that they have checked the labour market and that the position is unfilled by an Australian citizen or permanent resident.
  • Proof of a genuine position: Your company must provide proof that you will be performing the duties listed in your contract and that the nominated position actually exists.
  • Proof of exemptions: Your employer must show that they meet the exemption standards if they think the nominated position is subject to restrictions or that labour market testing is not necessary.

Understanding the Transition from Subclass 457 to Subclass 482

Recently the Prime Minister of Australia announced that the Temporary Work (Skilled) visa (subclass 457 visa) will be abolished and replaced with the Temporary Skill Shortage (TSS) visa which will support home-based businesses with skill shortages. The Temporary Work Visa (subclass 457 allows skilled workers to work for 2 to 4 years in Australia with registered businesses depending upon the category of work and whether it is listed on the Medium and Long-term Strategic Skills List (MLTSSL) given by the government. Here are the new benefits and regulations for employees and employers under TSS:

  • Employers approved for subclass 457 will be able to sponsor skilled overseas workers under the TSS visa program.
  • If you currently hold a 457 visa in a Short-term Skilled Occupation List (STSOL) occupation, you can apply for a two-year TSS visa and a further two-year TSS visa onshore.
  • If a candidate has been granted a 457 visa after 18 April 2017 on the MLTSSL list. Then she/he can apply for a permanent 186/187 visa after 3 years on a 457 visa if that company decides to nominate you.
  • Subclass 457 visa holders who wish to change employers do not need to apply for a new TSS visa if their 457 is valid. The new employer must lodge a TSS 482 nomination application and link it to your 457 visa. This must be done before the 457 visa expires.
  • Subclass 457 visa holders who need a new visa are required to lodge a new TSS visa application.

How Long Can I Stay With a 482 Visa?

Generally, a 482 visa allows you to stay for up to four years. The short-term stream visa 482, on the other hand, is only valid for two years. If an ITO is filed for your visa, your short-term stream visa will be valid for four years.

If you are, then you have an ITO or an international trade obligation:

  • An intra-corporate transferee
  • An intra-corporate transferee from Singapore or Thailand
  • A citizen from China
  • An independent executive
  • A contractual supplier
  • A contractual supplier from Thailand

Can I Include Family Members on My 482 Visa?

Yes, you may apply with relatives that are part of your immediate family:

  • Your de facto partner or spouse.
  • Your minor child or the minor child of your partner.
  • Your own adult dependent child or the adult dependent child of your partner.
  • Your own or your partner’s descendant (minor or dependent).
  • You can include your family members who possess TTS visas issued because they are your family members if you previously held a 457 visa or a TTS visa. Please be aware that children include any individuals who are regarded as having a legal child, such as adopted or stepchildren.

Remember that you must show that your dependent children are actually reliant on you or your partner, whether socially, psychologically, physically, or financially, in order to receive benefits.
