The EB-5 Reform and Integrity Act of 2022 has restructured the EB-5 visa programme, mainly in the minimal investment period. Said changes approved by the United States Citizenship and Immigration Services (USCIS) that came on October 11, 2023, provides new anticipation for Indian students to start their education in the United States.<\/p>\n\n\n\n

Investors now have to maintain their money at risk for a minimum of two years after it is deployed to the job-creating organization (JCE) in tendering with the EB-5 Reform and Integrity Act of 2022. Due to these changes made by the RIA, investors now no longer have to maintain their investment for the duration of their conditional residency.<\/p>\n\n\n

Mandatory To Anticipate The Investment for At Least 2 Years<\/span><\/h2>\n\n\n\n

As an alternative, it is now mandatory to anticipate that the investment will last for at least two years, assuming that the prerequisites for job creation have been satisfied. Investors looking to obtain a US Green Card will find the process more easy as a result of this policy change.<\/p>\n\n\n\n

In comparison to other work or student visas, the EB-5 visa provides a more constant and long-term option, making it an apt option for Indian students. It not only makes it easier to get a good education and advance your job, but it also lays the groundwork for a long-term stay in the US\u2014after five years, you can apply to become a citizen.<\/p>\n\n\n\n

EB-5 Visa Leads To Green Card<\/span><\/h2>\n\n\n\n

Assuming that the EB-5 visa results in a green card, students would have more access to public colleges and universities in the US and would even be eligible for in-state tuition in some situations, which would drastically lower the cost of education.\u00a0<\/p>\n\n\n\n

On the other hand, it can provide more stability and flexibility, mitigating students of many of the limitations associated with other visa classifications. For example, students wouldn\u2019t have to worry about working (off-campus) or maintaining a full course load, which would set them to pursue part-time jobs, co-ops, or internships that would improve their practical experience.<\/p>\n\n\n\n
