This case particularly shaped Indian legal history by establishing a critical example of protecting citizens&#8217; rights under the Preventive Detention Laws. Furthermore, the core of the case centred on the Preventive Detention Act of 1950, which empowered the government to jail people suspected of threatening our national security, without a trial. In addition, A.K. Gopalan who was a communist leader, challenged the law&#8217;s Constitutionality. Moreover, while the Supreme Court&#8217;s judgment was unanimous, it was different from the previous passage. The Court did not uphold the law in its totality. This approach, emphasising the literal text of our Constitution, defined &#8220;law&#8221; within the Article as legislation passed by the State, not principles of Natural justice.&nbsp;<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Therefore, the Court differentiated the &#8220;Procedure Established by law&#8221; from the American concept of &#8220;Due process of law.&#8221;&nbsp;<\/li>\n\n\n\n<li>This difference limited the protection of Article 21 to protecting against random actions by the executive branch and not the legislature.&nbsp;<\/li>\n\n\n\n<li>Moreover, this interpretation remained prevalent for nearly three decades, hence culminating in the A.D.M.
